Curb weed eating / spraying

Our property manager would like to remind homeowners to either spray or weed eat the strip of growth between the curb and the street. There are a number of homes allowing this space to overgrow. Thank you for your help.

Camper Amendment Compliance Ruling

The HOA Board has reviewed the camper amendment and voted for the following:

Campers may be brought onto your lot within Gatewood Estates Section II with prior notice to our Property Manager for 48 hours for a unique usage/maintenance purpose. If you have multiple separate usage/maintenance purposes, you may submit a request to the Property Manager for multiple 48 hour consecutive on lot periods of time for each unique usage/maintenance purpose.

If the HOA Board finds that the process is being abused to store a camper on a lot indefinitely, the Board reserves the right to deny future 48 hour requests.

The above ruling applies to how a homeowner complies with the Camper Amendment and does not change the way the Board enforces HOA covenants.

Process for enforcement of violations to covenants

All covenant violations are observed and recorded by our Property Manager. The process for all violations is the same. Our Property Manager will drive thru the subdivision once every 2 weeks and document all violations. Courtesy letters will be sent to the relevant homeowners. The homeowner will be given an additional 2 weeks to comply before a lawyer letter is sent. This includes campers.

Homeowner complaints will be dealt with on a case by case basis. If the homeowner complaint is not against any HOA rules, a courtesy letter will be sent to the relevant homeowner if appropriate detailing a suggested (not required) remedy to maintain harmony in the neighborhood. If the complaint is a violation of the covenants, it will be handled in the same way as if our Property Manager had observed the infraction.

ATVs and safety on our neighborhood streets

We have received multiple complaints about ATVs driving through the subdivision and concerns have been expressed around safety. The HOA does not have authority to regulate use of ATVs and we recommend you contact the Sheriff.

Covenant Clarifying Guidelines

Under the “Our Governing Documents” page there is a new document linked to provide clarity on what the property management company will issue violation letters on. This document is meant to clarify what is being enforced. Specifically the following two lines of the covenants are being clarified with the “Home Maintenance Guidelines” portion of the document. The HOA board will no longer submit any violations to these guidelines. The Management Company will drive through the subdivision twice per month and all violations will be issued from the Management Company. The intent is not to increase enforcement of the rules, but to provide clarity on what is being enforced.

17. The developer of this subdivision, or its assigns, or the Architectural Control Committee reserves the right to enter upon any lot for any purpose of cutting grass and cleaning up such lot as is reasonably required and shall charge the expense thereof to the respective owner, which expense shall become a lien upon the lot when the work has been completed.

(f) Right of Entry. Without liability to any owner of a lot, to cause its agents, independent contractors, and employees after reasonable notice, or without notice in the event of an emergency, to enter upon any lot for the purpose of enforcing any of the rights and powers granted to the Association in the Instruments, Articles, and By-Laws, and for the purpose of maintaining or repairing any portion of the properties if for any reason whatsoever the Owner thereof fails to maintain it in good condition and repair and so as to present an attractive exterior or appearance as required by the documents, or as reasonably required to promote or protect the general health, safety, and welfare of the residents and users of the properties.

2020 New Board Elected

A new board was elected at the end of 2019 and the website has been updated to reflect the new members.

The 2019 documents have been added to the financials page and the proposed 2020 budget has been posted.

The first board meeting will be held later this month and we will be discussing updates to our management company contract, a proposed trailer amendment, and a published list of home and yard maintenance guidelines. Documentation will be posted here on the HOA website.
